B’nai Brith Canada’s 2015 Seminar
Genevieve Bertrand says this seminar will be in the format of a moot trial, drawing facts from actual cases to highlight issues of will challenges.
“In this hypothetical scenario, an illiterate elderly woman who only speaks Russian and Yiddish makes a will. Her unemployed son persuades his mother to transfer her home to him and make a new will that disinherits his sister. At the time the will was made, the mother suffered from Alzheimer’s. The lawyer who took instructions and saw to the execution of the will met with her twice and only spent 10 minutes translating the document to her. While under the care of her son, she drove her car into a pole resulting in irreversible brain damage. The moot court will highlight issues including capacity, undue influence, solicitor’s negligence and the feasibility of a will challenge while the testator is still alive.”
Clare Burns says the seminar will also educate attendees on the closing argument in the context of a will challenge.
“By hearing their closing arguments, attendees will learn how skillful trial lawyers artfully present their closing arguments by telling their respective clients’ narrative together with an analysis of the law.”
Other topics that will be covered include capacity, undue influence, solicitor’s negligence, the feasibility of a will challenge while the testator is still alive, and more.
